Terms of Service

1.Definitions

• “Soura AI”, “we”, “us”, “our” means Thamir Fuwad, a sole proprietor operating the Soura AI service from the Sultanate of Oman.
• “Service” means the Soura AI website, applications, APIs, and AI image generation features, including Country Packs for Oman, Saudi Arabia, and the United Arab Emirates.
• “Account” means the account you register to access the Service.
• “Inputs” means any text, prompts, configuration choices, product images, references, or other material you submit to the Service.
• “Outputs” means the images, variations, and metadata the Service generates in response to your Inputs.
• “Credits” means the internal unit used to measure generations on the Service. Credits are not money and have no cash value outside the Service.
• “Subscription” means a recurring plan that grants a monthly allowance of Credits.
• “Paddle” means Paddle.com Market Ltd., our Merchant of Record, which handles checkout, taxes, invoicing, and certain refunds on our behalf.

2.Eligibility and your Account

You must be at least 18 years old and capable of entering into a binding contract in your jurisdiction to use the Service. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that entity, and the word “you” refers to both you personally and that entity.

You are responsible for keeping your login credentials confidential and for all activity under your Account. Each person may only hold one Account unless we expressly agree otherwise in writing. You must not share your Account, sell access to it, or transfer it. Notify us immediately of any unauthorized access.

We may refuse registration, suspend, or terminate any Account at our discretion where we reasonably believe there has been fraud, abuse, non-payment, a chargeback, or a breach of these Terms.

3.Subscriptions, Credits, and Payment

Paid access to the Service is sold through subscription plans that grant a monthly allowance of Credits. Paddle acts as the Merchant of Record for all purchases. This means that when you buy a Subscription, your contract of sale for payment purposes is with Paddle, while your contract for the Service itself is with Soura AI under these Terms.

Subscriptions renew automatically at the end of each billing cycle using the payment method on file, unless cancelled before the renewal date. You can cancel at any time from the billing page; cancellation stops future renewals and your paid access continues until the end of the current billing cycle.

Monthly Credits reset at the start of each billing cycle and do not roll over. Any unused Credits from a given month expire when the cycle resets. Add-on or one-time Credit purchases, if offered, may have different expiry terms and are governed by their own purchase page disclosures at the time of checkout.

Prices, plan features, and Credit allowances may change. We will give you reasonable notice (at least 14 days where practicable) of any price increase before your next renewal. Continuing to use the Service after the change takes effect constitutes acceptance of the new price. Taxes and VAT, where applicable, are calculated and collected by Paddle at checkout.

All refund entitlements are set out in our Refund Policy, which forms part of these Terms. Chargebacks initiated without first contacting support may result in immediate suspension or termination of your Account and forfeiture of Credits.

4.Your Inputs

You retain ownership of your Inputs. By submitting Inputs to the Service, you grant Soura AI a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and transmit those Inputs solely for the purposes of: (a) providing and operating the Service to you; (b) generating Outputs you request; (c) enforcing these Terms, investigating abuse, and meeting legal obligations; and (d) improving service reliability, safety, and performance (for example, debugging failed generations).

We do not use your Inputs or Outputs to train third-party generative AI models, and we do not sell them to third parties for advertising or model training. Our underlying image-generation provider may process Inputs and Outputs transiently to produce the Output you requested, but we configure the Service so that Inputs are not retained by the provider for training.

You represent and warrant that you own, or have all necessary rights, licences, and permissions to submit each Input to the Service, including but not limited to any trademarks, logos, brand marks, product photography, or likenesses of any person that appear in your Inputs. You indemnify us against any claim that your Inputs infringe a third party’s rights (see Section 11).

5.Outputs and Ownership

Subject to your compliance with these Terms and payment of all fees due, to the maximum extent permitted by applicable law, Soura AI assigns to you such rights, title, and interest as it may have in the Outputs you generate. You may use the Outputs for personal or commercial purposes, including on websites, social media, advertising, print materials, and product packaging.

You acknowledge and accept that: (a) generative AI systems may produce similar or identical Outputs for different users from similar Inputs, and we cannot guarantee the uniqueness of any Output; (b) the legal status of AI-generated content, including whether it is eligible for copyright protection, varies by jurisdiction and is evolving; (c) we do not warrant that any Output will be culturally correct, historically accurate, free of artefacts, or fit for any particular purpose; and (d) you are responsible for reviewing every Output before publishing or commercially deploying it.

You grant Soura AI a worldwide, royalty-free, non-exclusive licence to use de-identified, aggregated, or anonymized data derived from Outputs (such as aggregate statistics on which Country Packs are used most often) to operate, secure, and improve the Service and for internal analytics. We will not publicly attribute any specific Output to your Account without your consent.

6.Acceptable Use

You must not use the Service to generate, upload, or distribute any of the following:

• Child sexual abuse material, or any content that sexualizes minors or depicts a person under 18 in a sexual or suggestive context.
• Non-consensual intimate imagery, “deepfake” imagery depicting a real identifiable individual without their consent, or content that impersonates a real person in a misleading or defamatory way.
• Content that depicts public figures (religious, political, or royal) of the Sultanate of Oman, Saudi Arabia, the United Arab Emirates, or any other country in a deceptive, defamatory, sexualized, or disrespectful manner.
• Content that is offensive to Islam, any other religion, or to the public morals and cultural values of the Gulf states in which the Service markets its Country Packs.
• Hate speech, content that incites violence or discrimination, or content that promotes terrorism or extremist organizations.
• Content that infringes any third-party intellectual property right, including trademarks, copyrights, design rights, trade dress, or rights of publicity and personality.
• Misleading political campaign content, election disinformation, or material designed to deceive voters or manipulate public discourse.
• Content that violates the laws of the Sultanate of Oman, including its cybercrime, press, and public-decency laws, or the laws of the jurisdiction in which you reside or from which you access the Service.

You also must not:

• Reverse engineer, decompile, scrape, or attempt to derive the source code, model weights, or training data of the Service.
• Use the Service, Outputs, or Inputs to train, fine-tune, or evaluate a competing AI model or image generation product.
• Use automated tools, bots, or scripts to access the Service outside of any documented APIs or beyond rate limits we communicate.
• Interfere with, disrupt, or circumvent any security, authentication, rate-limit, or Credit-metering mechanism of the Service.
• Resell, sublicense, or otherwise commercialize access to the Service itself (as opposed to the Outputs you generate).
• Use the Service in any way that could damage, disable, overburden, or impair our infrastructure or that of our service providers.

We reserve the right, but not the obligation, to review content generated or uploaded through the Service, to refuse to generate any Output, and to remove Outputs from your Account where we reasonably believe this section has been breached. Breach of this Section 6 is a material breach of these Terms and may result in immediate suspension or termination of your Account without refund.

7.Cultural Packs and Editorial Responsibility

Our Country Packs (currently Oman, with Saudi Arabia and the United Arab Emirates planned) represent our best effort to model regional attire, backgrounds, and conventions. They are a generative tool, not an editorial or religious authority. You are solely responsible for reviewing every Output for accuracy, appropriateness, and compliance with local law and social norms before you publish, advertise, or distribute it.

8.Service Availability; “As Is”

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation.

We do not warrant any specific level of uptime, response time, or generation quality. The Service depends on third-party providers (including Google for image generation, Supabase for database and authentication, Paddle for payments, and Cloudflare for DNS and network services). Outages or changes at any of these providers may temporarily impair the Service.

If a generation technically fails on our side (for example, a model error or server timeout), Credits consumed for that generation are automatically refunded to your balance. This auto-refund is your sole and exclusive remedy for that failure, without prejudice to any non-waivable rights under applicable consumer law.

9.Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Soura AI, or its owner, employees, contractors, or service providers, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, opportunities, or business, whether arising in contract, tort (including negligence), statute, or otherwise, even if we have been advised of the possibility of such damages.

Our aggregate liability to you for all claims arising out of or related to these Terms or the Service, whether in contract, tort, or otherwise, is limited to the greater of: (a) the total fees actually paid by you to Soura AI through Paddle for the three (3) months immediately preceding the event giving rise to the claim; or (b) one hundred United States dollars (USD 100).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including rights you may have as a consumer under the law of your country of residence.

10.Indemnification

You agree to defend, indemnify, and hold harmless Soura AI and its owner, contractors, and service providers from and against any and all third-party claims, demands, actions, losses, damages, liabilities, and costs (including reasonable legal fees) arising out of or related to: (a) your Inputs; (b) your use, publication, or commercial exploitation of any Output; (c) your breach of these Terms; or (d) your violation of any applicable law or of the rights of any third party.

11.Termination

You may stop using the Service at any time and cancel a Subscription from your billing page. Cancellation prevents future renewals but does not refund the current billing period except as set out in our Refund Policy.

We may suspend or terminate your Account immediately and without notice if we reasonably believe you have breached these Terms (including Section 6), engaged in fraud or abuse, initiated a chargeback without first seeking support, or failed to pay amounts due. On termination, your access to the Service and any unused Credits are forfeit, except where mandatory consumer law requires a refund.

Sections that by their nature should survive termination will survive, including Sections 4 (licence you grant us), 5 (ownership and disclaimers), 6 (acceptable use), 9 (limitation of liability), 10 (indemnification), and 13 (governing law and disputes).

12.Changes to the Service and Terms

We may modify, add, or remove features of the Service at any time. We may update these Terms to reflect changes in law, the Service, or our business. We will post the updated Terms on the Service and update the “Effective date” at the top. For material changes that affect your rights or obligations (for example, changes to fees, refunds, or dispute resolution), we will also give notice by email or in-app at least 14 days before the change takes effect, except where a shorter period is required by law, security, or regulatory need. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.

13.Governing Law and Disputes

These Terms, and any non-contractual obligations arising out of them, are governed by the laws of the Sultanate of Oman, without regard to its conflict-of-laws rules. You and Soura AI irrevocably agree that the competent courts of Muscat, Sultanate of Oman, have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that we may seek urgent injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

To the extent permitted by law, you agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action. Nothing in this Section affects any non-waivable statutory rights you may have as a consumer under the law of your country of residence.

14.Miscellaneous

These Terms, together with the Privacy Policy and Refund Policy referenced on our website, constitute the entire agreement between you and Soura AI regarding the Service and supersede any prior agreements. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign these Terms without our prior written consent. Neither party is liable for failure or delay in performance caused by events beyond its reasonable control (force majeure).
